Miam Boom is published by Martin Drapeau / Activite Messager Inc. ("we", "us"). These Terms of Use cover the Miam Boom app for iPhone, iPad and Mac (the "App") and the miamboom.com website, including the web version of the game (the "Website"). Together they are the "Service". By using the Service, you agree to these terms. If you do not agree, please do not use the Service.
Our Privacy Policy explains what information the Service collects and how it is used. In short, the App collects no personal data.
The App is free, with no ads, in-app purchases or accounts. It is distributed through Apple's App Store, and your use of it is also governed by Apple's Licensed Application End User License Agreement. Apple is not responsible for the App or its content, and has no obligation to provide support for it. If these terms conflict with Apple's agreement on the App, Apple's agreement applies.
Your best score and settings are stored on your device, and your best score is synced through your own iCloud account if you use iCloud. They can be lost if you delete the App or reset your device, and we cannot recover them.
When you share your score, it goes wherever you choose through your device's share sheet, under the terms of that service.

Miam Boom is made for players of all ages. The Service collects nothing from children.
The game, its art, characters and the Service are owned by us and our licensors and are protected by copyright and other laws. You may make videos and screenshots of the game. Other names and characters mentioned on the Service may be trademarks of their owners. We reserve all rights not expressly granted to you.
The Service may link to other websites and services we do not control. We are not responsible for their content or practices, and their own terms and policies apply.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT PROMISE THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR FREE, OR THAT YOUR BEST SCORE WILL NEVER BE LOST. SOME JURISDICTIONS DO NOT ALLOW THESE EXCLUSIONS, SO THEY MAY NOT APPLY TO YOU.
TO THE EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, OR FOR ANY LOSS OF DATA, ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE SERVICE. BECAUSE THE SERVICE IS FREE, OUR TOTAL LIABILITY TO YOU IS LIMITED TO CAD $10. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS, SO THEY MAY NOT APPLY TO YOU.
These terms are governed by the laws of the Province of Quebec and the federal laws of Canada that apply there. This does not take away any rights you have under the consumer protection laws of the place where you live.
We may update these terms. The new version will be posted on this page with a new date. If you keep using the Service after a change, you accept the updated terms.
If any part of these terms is found invalid, the rest still applies. If we do not enforce a part of these terms, we have not waived it. These terms and the Privacy Policy are the whole agreement between you and us about the Service.
